    路牌出现在废品站？团伙累计盗窃路牌及配件651块获刑

    　　消失的路牌出现在废品站 　　道路上发挥指引作用的交通标识牌，竟成为犯罪分子的盗窃目标。近日，经甘肃省灵台县检察院依法提起公诉，6名被告人分别因盗窃罪和掩饰、隐瞒犯罪所得罪获刑。 　　“路上好像缺了点什么？”2025年1月，灵台县公路段的职工小李在例行巡查中发现，G244国道什字镇至县城过境段多个交通引导牌不翼而飞，遂向公安机关报案。接到报案后，公安机关迅速展开侦查，通过调取沿线监控录像锁定犯罪嫌疑人柴某、唐某某，顺藤摸瓜，很快抓获了共同作案的杨某某等人。涉案的其余两人随后也投案自首。 　　“听说这东西(路牌)能卖钱，来钱快。”据杨某某供述，自2024年年底起，其伙同柴某、唐某某等4人，流窜于宁夏彭阳和固原原州、陕西旬邑、甘肃宁县等地，专挑金属制成的交通标识牌下手。经查，杨某某等人趁着凌晨，将所盗路牌运到赵某某经营的再生资源回收站销赃，谎称是“公路上废弃更换的”。赵某某明知来路不正仍照单全收，以每公斤10元的价格收购，再加价转卖给吴某某。截至案发，该团伙累计盗窃路牌及配件651块，价值近6万元，实际销赃获利1.8万余元。 　　2025年5月，公安机关将该案移送至灵台县检察院审查起诉。“偷走正在使用的路牌，会不会导致驾驶员误判，引发翻车、撞车等严重事故？”承办检察官王超经反复研判案情、查看现场、咨询专家，最终认为，案发地位于G244国道，涉案路牌主要起标识作用，其缺失虽增加行车风险，但尚不能认定达到了“足以使火车、汽车、电车、船只、航空器发生倾覆、毁坏危险”的法定标准，不宜认定为破坏交通设施罪。 　　对于收赃者的行为是否构成犯罪，承办检察官审查后认为，赵某某明知是犯罪所得仍多次收购，对盗窃行为的发展起到了持续的促进作用，构成掩饰、隐瞒犯罪所得罪；鉴于吴某某掩饰、隐瞒犯罪所得数额较小，主观恶性不大，系初犯、偶犯，犯罪情节轻微，对其作出不起诉决定。 　　经灵台县检察院提起公诉，法院经开庭审理，采纳了检察机关指控的全部犯罪事实、罪名和量刑建议，于近日依法以盗窃罪判处杨某某等5人有期徒刑二年至七个月不等，各并处罚金；以掩饰、隐瞒犯罪所得罪判处赵某某有期徒刑九个月，并处罚金3000元。 　　本报讯(记者南茂林 通讯员孙燕 于倩) 　　来源：检察日报 【编辑:陈海峰】|dfg|
