    　　手机一晃就被迫看广告？APP强制跳转亟待治理 　　律师：应出台强制标准，明确跳转触发条件、灵敏度上限 　　本报讯(记者陈丹丹)“只是向上一滑，马上跳转到购物网站”“随手晃了下手机，再一看进入了游戏页面”“‘立即查看’和‘×’的标志几乎挨着，太容易误触了”……《工人日报》记者近日选取多款APP实测发现，广告乱跳转的问题依然时有发生。 　　在实测过程中，记者点开某款壁纸APP，在页面上方和下方看到同一购物网站的广告。其中，位于上方的广告页面与手机系统收到消息的页面较为相似。然而，记者仅将该广告向上一滑，页面立刻跳转至某购物网站。 　　点开另一款拍照APP后，记者看到，在其开屏页下方出现一则游戏广告。在广告图片的右方，标有“立即查看”和“×”符号，字号较小且位置隐蔽。记者多次尝试点击该APP中的“×”符号，均跳转至广告页面。 　　不仅如此，还有部分APP依托手机设备自带的传感功能，设置“摇一摇”跳转广告。“频繁被跳转至广告页面，非常影响心情。”河南郑州消费者谢先生告诉记者，为了避免被强制跳转，他在多个社交平台上搜索过解决广告恶意跳转的操作流程和攻略。 　　“效果不明显，而且即便是关闭或卸载了某个软件，强制跳转广告的新方式仍然层出不穷，在其他软件上稍不注意又会‘被跳转’。”谢先生说。 　　对此，广东耀文律师事务所律师张爱东表示，“摇一摇”等动作本身难以被明确界定为法律意义上的“意思表示”。 　　张爱东进一步分析认为，依据相关法律法规，“意思表示”主要包括“明示”和“默示”两类。“而‘摇一摇’‘滑一下’等动作的性质介于二者之间，若是在非受控环境下极易因手机晃动或无意触碰而触发，无法确认用户的真实意图，难以区分是误触还是自愿。”在张爱东看来，APP设定以“摇一摇”等方式作为认定用户“意思表示”的方式，本就缺乏法律依据。 　　记者注意到，监管部门于今年11月通报手机行业不正当竞争典型案例，并指出部分企业利用技术、数据、平台规则等优势实施流量劫持、强制跳转、恶意不兼容等不正当竞争行为，强调手机行业相关经营者要坚决停止并防范各类不正当竞争行为。 　　“关键在于强化对APP开发与运营主体的监管。”张爱东建议，应由相关监管部门牵头研究制定并出台具有强制约束力的国家或行业标准，明确“摇一摇”等传感交互广告的触发条件、灵敏度上限、视觉提示、取消机制及用户同意前提等技术细节与合规要求，维护用户合法权益。 　　《工人日报》(2025年12月23日 04版) 【编辑:周驰】|dfg|
