    　　以消费券形式发放工龄补贴，违法！ 　　消费券不具有法定货币的流通性，“以券抵薪”侵害劳动者获得劳动报酬的权益 　　又到年终岁末，对于劳动者来说，最重要的莫过于薪水落袋。辛苦工作一整年，却换来一堆消费券、购物卡，甚至是用米面粮油等实物来冲抵薪资？注意，这不是福利，而是企业的违法操作。 　　近日，江苏省苏州市中级人民法院审结了一起劳动合同纠纷案。该案中，2023年1月至6月期间，某网购平台供应链公司以消费券的形式发放小刘的工龄补贴，该消费券无法提现，且只能在指定平台消费。该行为违反了法律的强制性规定，于是一审、二审法院均判决支持小刘要求供应链公司以货币形式支付工龄补贴差额2065.53元的诉求。 　　用消费券、购物卡或以米面粮油等各类实物替代货币发工资，甚至将其标注为“福利补贴”，尽管它们的票面价值可能等于或高于本该到手的实际工资，但一般都会被限制在特定平台使用，无法像货币一样在市场上自由流通。 　　劳动者遇到这类情况，该如何从法律角度形成正确认知并合法维权？ 　　苏州市中级人民法院劳动法庭庭长沈军芳表示，上述案例中，用人单位可能出于降低运营成本、激发消费热情等因素考量，直接用消费券来给员工发工资，表面看似“两全其美”——企业减少现金压力，内部平台获得流量。然而，这种操作实则既不合适更不合法。 　　我国法律对工资支付形式有明确而严格的规定，没有任何模糊空间。《中华人民共和国劳动法》第五十条明确规定：“工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。”《工资支付暂行规定》第五条进一步细化：“工资应当以法定货币支付。不得以实物及有价证券替代货币支付。”无论是自产产品、购物卡，还是限定用途的消费券，都属于“实物及有价证券”范畴，均在禁止之列。 　　苏州市中级人民法院劳动法庭副庭长杨俊生表示，劳动者有通过劳动获得劳动报酬的权利，工资是劳动者生活的主要来源和基本保证，以货币形式支付工资是为了确保劳动者通过劳动获取报酬并可以正常、广泛地流通使用，依法规范用人单位的工资支付行为具有必要性。将一部分工资转为消费券，虽然表面数额是一样的，但性质不同，消费券通常用于特定平台或场所兑换商品或服务，不具有法定货币的流通性，侵害了劳动者获得劳动报酬的权益。 　　沈军芳提醒，用人单位须注意，任何以非货币形式支付工资的行为都是法律明确禁止的，发工资必须“发钱”，即以货币形式予以支付，不能用消费券、购物卡、代金券或实物等非货币代替。劳动者遇到这种情况，别轻信“公司困难”“福利替代”等说辞，及时收集证据，依法维权。 　　本报讯 (记者黄洪涛 通讯员周蕤 艾家静) 　　《工人日报》(2025年12月18日 06版) 【编辑:陈海峰】|dfg|
