    　　中新社北京12月17日电 (记者 刘亮)中国国家市场监管总局反垄断执法一司副司长刘健17日透露，市场监管部门将加快推动《互联网平台反垄断合规指引》(下称《指引》)出台，未来平台要求商家“全网最低价”或构成滥用市场支配地位或者垄断协议行为。 　　当日，国家市场监管总局召开民生领域反垄断执法专项行动成果宣介专题新闻发布会，刘健在会上作上述表示。 　　国家市场监管总局今年11月发布《互联网平台反垄断合规指引(征求意见稿)》，旨在更好地帮助平台经营者精准识别、评估、防范反垄断合规风险，进一步明晰行为边界。 　　刘健指出，平台经济具有明显区别于传统经济的竞争特点。如头部平台企业规模效应、网络效应明显，易于开展跨界竞争、快速扩张，实现“赢者通吃”；平台企业作为“关键一个”，相对于平台内商家和消费者等“庞大一群”具有天然优势，具有制定规则、掌握数据、利用算法、分配流量的管理者属性。同时，平台经济具有独特的商业逻辑和行为模式，涉及平台生态多方主体利益，如何科学划定行为边界更为复杂。 　　刘健称，从监管实践看，平台经济领域垄断风险较为突出，平台企业反垄断合规意识和能力有待提升，在此背景下，研究制定《指引》，目的是引导平台企业加强风险识别、风险管理和合规保障，有效防范反垄断合规风险，促进平台经济创新和健康发展。 　　刘健介绍，《指引》总结执法经验，提示具有市场支配地位的平台企业，要避免通过惩罚性或者激励性措施实施“二选一”行为；提示平台要求商家“全网最低价”行为可能构成滥用市场支配地位或者垄断协议行为。针对平台“算法黑箱”损害平台内商家和消费者利益，《指引》还列举“算法共谋”等风险示例，同时鼓励平台企业开展算法筛查，构建算法垄断识别防控体系，从源头上防范垄断行为发生。(完) 【编辑:张令旗】|dfg|
