    核查全网最低价、“二选一”等问题 民生领域反垄断执法见成效

    　　记者今天(12月17日)从市场监管总局民生领域反垄断执法专项行动成果宣介专题新闻发布会了解到，反垄断执法是维护公平竞争、保障民生权益的重要手段。专项行动以来，市场监管总局聚焦人民群众反映强烈的垄断问题，查处了一批典型案件，惩戒了一批违法主体，以“执法力度”提升人民群众幸福指数。 　　一是强化重大案件查办。始终把执法办案作为工作主线，坚决纠治侵害群众利益的垄断问题。 　　三年来，市场监管总局共查处垄断协议案件35起、滥用市场支配地位案件25起，罚没款总计29.3亿元，切实保障消费者权益，维护公平竞争市场秩序。 　　审结民生领域经营者集中案件950起，支持企业通过并购提升经营效率。 　　办结滥用行政权力排除、限制竞争案件148起，纠治地方保护和市场分割等妨碍公平竞争市场秩序问题。 　　二是聚焦重点领域攻坚。 　　保持医药领域高压严惩态势，三年共查处12起重大典型案件，其中上药生化案、津药药业案、上海信谊联合案分别罚没12.19亿元、3.62亿元和2.23亿元，对违法主体形成有力震慑，涉案药品降价均超过40%，降幅最高达95%，降低了患者用药成本和国家医保支出。 　　加大公用事业领域整治力度，查处威海水务案、南京中燃案等水电气暖领域垄断案件16起，罚没金额1.83亿元，有力纠治限定交易、搭售等典型垄断行为，降低了下游用户生产成本，保障了消费者自主选择权。 　　强化平台经济领域常态化监管，密切关注平台竞争行为，深入核查全网最低价、“二选一”等问题，对损害中小商户和消费者利益的平台经营者进行公开约谈。制定《互联网平台反垄断合规指引》，明确提示算法共谋、差别待遇等8个场景的新型垄断风险。 　　聚焦交通、教育等民生领域“关键小事”，依法查处涉及77家机动车检测企业、22家驾驶培训机构、12家保险公司的垄断协议案件，严厉打击串通涨价、分割市场等行为，推动涉案主体提质降费，让群众“得实惠、有选择、享公平”。 　　三是加快制度规则完善。落实2022年修改的《中华人民共和国反垄断法》，发布1部条例，即《公平竞争审查条例》，出台了《禁止垄断协议规定》《禁止滥用市场支配地位行为规定》《经营者集中审查规定》等5部部门规章，起草药品、公用事业等10部反垄断指南指引，构筑起公平竞争法治的“四梁八柱”，既为执法机构提供办案指引，也为经营主体营造公平透明可预期的营商环境。比如，“安全港”制度为经营者纵向协议提供清晰的风险边界，为广大中小企业释放创新发展空间。《关于行业协会的反垄断指南》为行业协会依法自律、规范履职提供了清晰、可预期的行为规则。 　　四是深化长效竞争治理。加强部门协同，在信息共享、风险研判、执法调查、合规整改等方面开展监管协作，将竞争政策融入行业治理，从根源上铲除垄断滋生的土壤。加强企业合规，面向医药、公用事业、平台经济等领域的企业和行业协会举办21期合规讲堂，培训8万人次。加强社会监督，畅通投诉举报渠道，及时公开行政处罚决定，发布48个典型案例，确保公众监督“有入口、有回声、有实效”。 　　下一步，市场监管总局将全面贯彻党中央、国务院决策部署，持续加强反垄断监管执法，以扎扎实实的工作成效，为加快建设全国统一大市场、推动经济高质量发展作出新贡献。 　　(总台央视记者 高杰) 【编辑:张令旗】|dfg|
