    白皮书：网络侵害公益行为隐蔽性更强

    　　中新网北京12月19日电(韦安 匡晶丹 陈明慧)北京铁路运输检察院(以下简称“北京铁检院”)18日发布的《互联网检察公益诉讼白皮书(2023-2025)》(以下简称白皮书)显示，当前互联网公益诉讼案件的办理重点逐渐延伸至深层次危害的实质化治理，在线索发现、调查取证、法律适用等方面呈现出新的特点。其中，网络侵害公益行为隐蔽性更强，互联网新业态交易模式与样态不断创新，违法行为通常经过合法形式伪装，识别难度加大。 　　白皮书显示，2023年1月至2025年5月，北京铁检院共受理线索142件，立案办理113件，其中行政公益诉讼111件，民事公益诉讼2件。 　　从办案领域来看，法定领域中，食品药品安全领域立案数占比最大，为58.57%；生态环境和资源保护领域立案数占比16.22%；安全生产领域占比11.71%；个人信息保护领域占比4.5%；文物保护领域占比3.6%；反电信网络诈骗领域占比0.9%；新领域中，网络治理领域占比1.8%，消费者权益保护领域占比1.8%，文化遗产保护领域占比0.9%。 　　从办案成效来看，北京铁检院综合运用检察建议、磋商、座谈等多种方式履职，督促行政机关检查商家17900余家，立案查处1418家，罚没金额600余万元，推动各平台下架商品2200件、处置店铺230余个，整改企业80余家，移送线索144件；推动互联网平台企业履行社会责任，各平台企业清理各类违法视频和图文等信息44万余条，封禁及处理相关账号86857个，处置评论423006条，进行内容管控6000余条，添加补充屏蔽和送审敏感词797组，实现域名解析203个；进行普法宣传50余次，发放普法宣传材料3000余份。 　　白皮书显示，网络侵害公益行为隐蔽性更强，互联网新业态交易模式与样态不断创新，违法行为通常经过合法形式伪装，识别难度加大。例如，在督促整治网络平台为禁用猎捕工具提供交易服务行政公益诉讼案中，平台内经营者为上架禁用猎捕工具，在商品详情页使用“防鸟网”“捕捉二师兄”“补麻却”表述代替“捕鸟网”“捕捉野猪”“捕捉麻雀”等词汇进行宣传，以逃避平台监管。 　　白皮书提出，新业态违法情形嵌套多重法律关系，给法律适用带来一定挑战。例如，在督促整治口碑营销公司互联网不正当竞争行为行政公益诉讼案中，对于搜索引擎优化(黑SEO)及虚构用户评价等是否属于不正当竞争行为，是否可以适用反不正当竞争相关法律法规，需要综合考虑法理研究、司法裁判、行政机关执法标准、搜索引擎算法规则，才能在深入了解违法行为的运作模式的基础上，精准识别损害公益的行为本质。 　　根据白皮书，网络公益侵害证据取得固定技术不断迭代升级，随着违法行为逐步复杂、证据标准逐步提高、公益侵害风险逐步提升，传统静态截图与动态录屏已难以满足办案需求，需加强与技术部门协作，依托专业技术手段保障取证固证的规范性、准确性和科学性。(完) 【编辑:张令旗】|dfg|
