    在亲戚32万元借条上签名被判连带还钱！法官提醒→

    　　在借条中，除出借人和借款人外，还经常出现第三人的签名，这些签名往往因为位置、表述和形式不同，引发第三人承担责任的争议。近日，湖南省宁乡市人民法院审理并宣判了一起民间借贷纠纷。 　　据悉，周某与王某系朋友关系，王某与李某系亲戚关系，经王某介绍，周某与李某相识。2019年，李某向周某借款32万元，并出具借条一张，底部记载“担保人王某”。2023年，双方再次结算，李某向周某出具借据一张，并在借据背面手写还款承诺，底部记载“借款人李某”，在该记载处下方另记有“连带担保人王某”。因借款未还清，周某起诉要求李某偿还借款本息，并要求王某承担连带清偿责任。 　　诉讼中，李某称王某签字的借条及还款承诺中“担保人”“连带担保人”字样均系自己在王某签字后经周某要求在王某签名前添加，王某对此不知情，仅是作为见证人签名。王某称其仅签了名字，并没有担保的意思。周某则称借条及还款承诺系李某出具后，写好“担保人”“连带担保人”字样再由王某签名。 　　宁乡市人民法院经审理后认为，合法的借贷关系受法律保护。 　　关于王某的责任，法院认为： 　　从还款承诺的形式上看，“连带担保人”五个字不是王某书写，而是借款人李某书写，王某辩称其是见证人，不应承担担保责任。但王某作为完全民事行为能力人，具备一定生活阅历及知识水平，应当知道在还款承诺上签字的法律后果，如王某仅有见证人或者在场人的意思表示，就应在本人签名前写好自己在案涉借款中的角色，而不应该在签名前留下空白给他人书写内容，加重本人责任，且李某出具的两张条据，王某均进行了签名，其称添加字样均未告知王某，不符合逻辑和常理。 　　从签字形式和正常书写习惯来看，还款承诺上书写和签名顺序应是横向从上到下、从左到右，李某和王某分别在借款人、连带担保人处签名符合从上到下、从左到右的书写习惯，如果王某签名之间“连带担保人”五个字不存在，也未注明“见证人”，其直接在借款人下方签名，则应认定为共同借款人，周某更无需要求李某在王某签名处另添加“连带担保人”字样，仅凭李某陈述，不足以认定王某主张其作为见证人在还款承诺上签名的观点。 　　综上，法院最终判决李某承担还款责任的同时，判决王某对债务承担连带清偿责任。目前该案已生效。 　　法官提醒：为避免因签字位置或身份不明引发纠纷，第三人在借条、借据、还款计划等债权凭证上签字时应规范书写，明确注明借款人、担保人、见证人身份，如果不是借贷双方、也不是担保人的，最好不要在借条、借据、还款计划等债权凭证上签字。 【编辑:胡寒笑】|dfg|
